Dear Community,

I have just received memo for my transition program from an MBB firm. It said that all of my remaining unused annual leaves can not be cashed out and need to be utilized during this transition program.

However, on my work agreement, they said that if there is any termination, the remaining unused leave days can be cashed out (which is aligned with the country law)

I have checked with them regarding this and basically they said that that's the package of Transtion program. In other words, they are saying the work agreement is overwritten by the transition agreement.

I have not signed yet. Am I being cheated? Should I push or not?

Hi there,

We are not lawyers. 

We also have not seen your contract.

We also have not seen the exact wording that they have used in their communications with them.

I can see both sides of the argument legally, but, ultimately, you need to talk to a lawyer.

Hi there!

I doubt you're being cheated, but it does sound fishy. 

I'd get some legal advice on this to understand whether these sorts of documents can be superseding and also to get a sense of your options. 

Don't sign just yet. It definitely doesn't sound fair.

Hello,

I agree with Ian here - I'm not sure which agreement would override which. It might be best to talk to a lawyer.
